Terms of Service
These Terms of Service (“Terms”) govern your access to and use of WebMenu (the “Service”), operated by WebMenu (“we”, “us”, “our”). By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy.
1. The Service
WebMenu is a software-as-a-service product that lets restaurants, cafes, and guesthouses create mobile-friendly digital menus accessible via QR code. Features include menu management, image uploads, QR code generation, anonymous diner ratings, and publishing controls.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. If you sign up on behalf of a business, you represent that you are authorized to do so.
3. Accounts
- You are responsible for the accuracy of the information in your account.
- You are responsible for maintaining the confidentiality of your password and for all activity under your account.
- You must verify your email address before signing in. Accounts with unverified email addresses cannot log in.
- Notify us immediately at support@webmv.info if you suspect unauthorized access to your account.
4. Your content
“Your Content” means the menu information, images, and other materials you upload to the Service — including venue names, item descriptions, photos, prices, and contact details.
- You retain ownership of Your Content.
- You grant WebMenu a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating the Service (including rendering your public menu page to diners).
- You represent and warrant that you have the rights necessary to upload Your Content and that it does not infringe on any third party’s rights.
5. Acceptable use
You agree not to use the Service to:
- Upload content that is illegal, infringing, defamatory, hateful, obscene, or that misrepresents the business’s offerings.
- Impersonate any person or business you are not authorized to represent.
- Attempt to probe, scan, or test the vulnerability of the Service or its underlying infrastructure.
- Interfere with or disrupt the Service, including by circumventing rate limits or bot-protection measures.
- Scrape, bulk-download, or mirror public menu pages without written permission.
- Use the Service to send unsolicited communications.
We reserve the right to suspend or terminate accounts that violate these rules.
6. Ratings
- Diner ratings are anonymous. WebMenu aggregates them into a per-dish average and count.
- We use Cloudflare Turnstile and per-device cookies to reduce spam and duplicate submissions, but cannot guarantee ratings reflect actual diner experience.
- Account holders may request that we reset the ratings for a venue at any time; administrators can also reset ratings through the admin panel.
- We may remove ratings that appear to be the result of abuse or manipulation.
7. Plans, fees, and billing
WebMenu is currently offered on a pilot plan, which is free of charge. We may introduce paid plans in the future and will provide reasonable notice before any fees apply to your account. Until then, use of the Service incurs no subscription fees.
8. Availability and changes
We aim to keep the Service available, but do not guarantee uninterrupted access. We may modify, add, or remove features at any time. Where changes materially reduce functionality you rely on, we will make a reasonable effort to notify you in advance.
9. Termination
- You may stop using the Service and request deletion of your account at any time by contacting us.
- We may suspend or terminate your access if you breach these Terms, if required by law, or if operation of the Service to you becomes impractical.
- Upon termination, your right to use the Service ends. Sections that by their nature should survive (including ownership, disclaimers, liability, and governing law) will continue to apply.
10. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, WebMenu disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
11. Limitation of liability
To the fullest extent permitted by law, WebMenu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our aggregate liability for any claim related to the Service shall not exceed the greater of (a) the fees you paid to us in the twelve months preceding the claim, or (b) fifty US dollars ($50).
12. Indemnification
You agree to defend, indemnify, and hold WebMenu harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the Republic of Maldives, without regard to its conflict of laws rules. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Maldives.
14. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, notify account holders by email. Continued use of the Service after the changes take effect means you accept the updated Terms.
